1. Acceptance of Terms

By downloading, installing, or using the No Fair app ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

The App is operated by Paweł Szczabel, ul. Wygodnowa 51/2A, 45-402 Opole, Poland (NIP: 9910361892).

2. Description of Service

No Fair is a mobile application that allows users to anonymously express emotions (such as unfairness, anger, or loneliness) by sending signals. Other users can support these signals anonymously. The App promotes emotional expression in a safe, judgment-free environment.

3. Account Registration

You must create an account using a valid email address or Sign in with Apple.
You must be at least 13 years old to use the App.
You are responsible for maintaining the security of your account credentials.
One account per person. Multiple accounts may be terminated.

4. Acceptable Use

You agree to:

Use the App only for its intended purpose of emotional expression and anonymous support.
Not attempt to reverse-engineer, hack, or exploit the App.
Not use automated tools or bots to interact with the App.
Not circumvent rate-limiting or other abuse-prevention measures.
Comply with all applicable laws, including EU regulations.

5. Rate Limiting

To ensure fair usage, the App enforces rate limits:

After each signal, there is a 1-minute cooldown period.
Sending 3 signals within 5 minutes triggers a 15-minute lockout.
These limits are enforced both client-side and server-side.

Attempting to circumvent these limits may result in account suspension.

6. Subscriptions & Payments

The App offers optional paid subscriptions processed through Apple App Store or Google Play Store.
Subscription terms, pricing, and renewal policies are governed by the respective store's terms.
You can manage or cancel subscriptions through your device's subscription settings.
Refund requests must be directed to Apple or Google, as applicable.

7. Intellectual Property

All content, design, code, and branding of No Fair are the property of Paweł Szczabel. You may not copy, modify, distribute, or create derivative works based on the App without written permission.

8. Disclaimer of Warranties

The App is provided "AS IS" without warranties of any kind, either express or implied. We do not guarantee:

Uninterrupted or error-free operation.
That the App will meet your specific requirements.
The accuracy or reliability of any information provided through the App.

No Fair is not a mental health service. If you are experiencing a crisis, please contact a professional mental health provider or emergency services.

9. Limitation of Liability

To the maximum extent permitted by law, Paweł Szczabel shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Account Termination

You may delete your account at any time from the Settings screen.
We reserve the right to suspend or terminate accounts that violate these Terms.
Upon termination, your data will be handled according to our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Republic of Poland and applicable EU regulations. Any disputes shall be resolved by the competent courts in Opole, Poland, without prejudice to your rights under EU consumer protection law.

12. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted in the App with a revised "Last Updated" date. Continued use after changes constitutes acceptance.
